GENERAL TERMS AND CONDITIONS OF SALE OF THE OFFICIAL WEBSITE MAISON-FEVRE.FR

PURPOSE

The purpose of these General Terms and Conditions of Sale is to set out the terms and conditions under which MAISON FEVRE sells watch straps and leather goods (hereinafter referred to as “The Product(s)”) to its Customers on the Official e-shop (the “Site”) www.maison-fevre.fr.

MAISON FEVRE is an entity of the company Fleurus, a simplified joint-stock company, registered in the trade and companies register of Cusset under the number Siret 975 920 380 and whose registered office is located at 33 Rue du Léry 03700 Bellerive-Sur-Allier (France); Telephone: +0(4) 15 40 10 30 (Monday to Friday from 9 a.m. to 12 p.m. and from 2 p.m. to 4:30 p.m. - Excluding public holidays); Email bonjour@maison-fevre.fr .

Acceptance of these General Terms and Conditions of Sale (“GTC”) implies the customer full and unreserved acceptance of these GTC, which are accessible at any time on this web page and allow for printing and/or saving.

CUSTOMER

The Customer declares that they are at least 18 years old and has the legal capacity (within the meaning of Articles 1123 et seq. of the Civil Code) or has parental authorization allowing him to place an order on the Site.

When placing their first order on the Site, the customer is required to create an account in the “My Account” section. The customer must complete a form specifying certain mandatory fields in order for their order to be processed by the MAISON FEVRE team.

The information provided to MAISON FEVRE must be complete, accurate, and up-to-date by the Customer with each order. The Customer can access the “My Account” section at any time.

PRODUCTS

Product characteristics are presented on the Site. If the Customer has any questions, they can contact MAISON FEVRE on weekdays, by telephone at: +0(4) 70 58 74 59 (Monday to Friday from 9 a.m. to 12 p.m. and from 2 p.m. to 4:30 p.m. - Excluding public holidays) or by email at: bonjour@maison-fevre.fr .

Product photographs are not contractually binding. The Customer acknowledges that the product photographs displayed on the Website are for illustrative purposes only. Indeed, the quality of the photos and the settings of the screen(s) (smartphone, computer, tablet) may alter the overall appearance (brightness and/or colors of the products).

PRICE

The prices displayed on the Site are indicated in euros, inclusive of all taxes (TTC) (French VAT applicable on the day of the order), excluding shipping costs offered in addition.

Items are billed based on the rates in effect at the time the order is registered on the Site.

Shipping costs (including insurance) are indicated before final order confirmation.

Prices may be changed at any time without notice, particularly in the event of changes to tax or economic data.

Promotional offers, privileges, and limited-time offers cannot be combined.

ORDER ON THE WEBSITE

To place an order on the Site, the following steps are required:

  • adding one or more Product(s) to the basket;
  • verification, at any time, of the Product(s) added to the basket;
  • modify the items in the cart;
  • continue shopping or finalize the order;
  • Order confirmation: for a first order, creation of an account is required or connection to the account using personal credentials (update of personal data if necessary: address, telephone, …).
  • final check of order details;
  • choice of delivery method by the carrier;
  • acceptance of the terms and conditions;
  • choice of payment method;
  • Payment confirmation.

All orders will only be validated after payment has been accepted. The product(s) remain the property of MAISON FEVRE until full payment of the price.

MAISON FEVRE reserves the right to refuse, cancel and terminate orders at any time for legal and/or legitimate reasons.

MAISON FEVRE will also be entitled to refuse any order made by a Customer with whom there is a dispute relating to any order not in accordance with these Terms and Conditions as well as the payment of a previous order.

In these circumstances, MAISON FEVRE will inform the customer by telephone or email.

If, despite the vigilance of the MAISON FEVRE team, any Products displayed on the Site are unavailable, MAISON FEVRE will inform the Customer as soon as possible. If payment has been made, the Customer will be offered several solutions, including the option to cancel their order and receive a full refund.

PAYMENT

The Site offers payment by credit card (Visa, Eurocard/Mastercard) as well as by Paypal account.

MAISON FEVRE does not accept payment by check. The customer must use one of the payment methods offered above.

Amounts paid shall not, under any circumstances, be considered deposits or advance payments.

When the order is finalized, the MAISON FEVRE team confirms the payment by sending the Customer a summary email.

MAISON FEVRE ensures a secure website with an address starting with “https://”.

Payment for purchases is made via the secure platform of our banking provider.

PAY IN INSTALLMENTS WITH ALMA

Payment in installments/deferred payment is available through our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.

Purchase amount

  • Payment in two installments (2 installments) with a 0.82% fee contribution: only purchases between €50 and €2,000 are eligible for payment with Alma.
  • Payment in three installments (3 times) with a 1% fee : only purchases between €50 and €2,000 are eligible for payment with Alma.

Costs

By paying in installments with Alma, the customer pays little in fees because Maison Fèvre contributes to the costs.

Alma is a online payment provider and issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the civil code.

Termination

Any termination of the General Terms and Conditions of Sale which bind the Seller and the customer, entails the termination of the General Terms and Conditions of Use between Alma and the customer.

DELIVERY

MAISON FEVRE delivers its products in Europe.

Depending on the products shipped, MAISON FEVRE has selected a padded envelope or a reinforced cardboard box to ensure the safe and secure delivery of the product(s). To guarantee discretion, the MAISON FEVRE brand name does not appear on the package.

Orders are processed from Monday to Friday inclusive, excluding public holidays.

Products are shipped to the delivery address provided by the Customer when placing their order. Delivery cannot be made to a hotel or a post office box.

MAISON FEVRE cannot be held responsible for any consequences due to a delivery delay that is not its fault.

The MAISON FEVRE team pays close attention to the preparation and delivery of your order in France and Europe.

The choice of a carrier, which determines the delivery time, is offered below.

From the date of order dispatch, the average delivery times are as follows:

  • Delivery by Colissimo in France: 2 working days.
  • Delivery via Colissimo in Europe: 3 to 5 working days.

MAISON FEVRE offers Colissimo delivery at the customer's choice:

  • at a collection point of their choice;
  • or “signature required” at the customer fixed address (residence or place of work).

If the customer is absent on the day of delivery:

  • “with signature required”: the package is available for 15 days at the Post Office;
  • At a collection point: the parcel is available for 10 days.

After the deadlines mentioned above, the package will be returned to MAISON FEVRE. The customer must contact customer service to request the return of their package at their own expense.

Promotional offers for free delivery:

When Maison Fèvre offers limited-time free shipping promotions, these are valid exclusively for shipments to mainland France and countries within the European Union. They do not apply to deliveries to the French overseas departments and territories, namely: Guadeloupe, Réunion, Mayotte, Martinique, Saint-Barthélemy, Saint-Martin, Saint-Pierre-et-Miquelon, New Caledonia, French Polynesia, and Wallis and Futuna.

ORDER RECEIPT AND REFUND

Upon receipt of the package, the Customer (or a person authorized by him) must immediately check the condition of the packaging and the delivered Product.

In the event of a damaged package or broken product (crushed, torn or open package), the Customer (or the person authorized by him) must refuse the package and state the reason on the delivery slip.

Failure to meet this deadline does not preclude the Customer from obtaining an exchange or refund for Products in the event of damage or defects, provided the package is not damaged upon delivery. Similarly, the Customer retains their right of withdrawal under the conditions outlined in the "DELIVERY" section below.

RIGHT OF WITHDRAWAL / PRODUCT RETURN

In accordance with the provisions of Articles L 221-18 et seq. of the French Consumer Code, the Customer may cancel their order at their discretion. They have a right of withdrawal which they may exercise within 30 days from the date of purchase (60 days during the Christmas holidays).

Delivery charges, applied on the day of purchase, remain the customer's responsibility and are refunded if the right of withdrawal is exercised, in accordance with Article L221-24 of the French Consumer Code. Please note that return shipping costs remain the customer's responsibility, as per Article L221-23 of the French Consumer Code. To simplify this process, MAISON FEVRE provides a prepaid return label, the fixed amount of which, identical to the initial delivery charges, is deducted from the total amount.
Example: In the event of a return, the customer is refunded the full price of the returned items in perfect condition and the initial delivery charges, less the cost of the prepaid label provided by MAISON FEVRE via its online returns portal. The total amount refunded therefore corresponds to the total price of the items purchased and returned in perfect condition.

The Customer is invited to use our online product return platform to request a refund or exchange, with the option to print a prepaid Colissimo shipping label: >> Click here to print your prepaid shipping label for returning your order . This does not apply to customers residing in Switzerland or French Overseas Territories, for whom customs duties and return shipping costs remain the Customer's responsibility, in accordance with Article L-221-23 of the French Consumer Code. Therefore, customers residing in Switzerland or French Overseas Territories cannot use our online return platform.

The return shipment is made at the Customer’s risk. The Product must be returned in its original packaging, in its original condition, new, unworn, unwashed, and must be accompanied by the invoice available in the “My Account” section, which shows the order references and the Customer's contact details.

If the Customer fails to comply with these conditions, in particular the return conditions, MAISON FEVRE will not be able to refund the Product(s) concerned.

PRODUCT WARRANTY AND RETURNS = 2 YEARS SUBJECT TO CONDITIONS

The MAISON FEVRE team pays close attention to the quality of its products.

The 2-year warranty (two years) begins on the day the order is validated (purchase date mentioned in the invoice available in the "My Account" section).

The warranty naturally covers hidden defects in the Product(s) ordered on the Site.

The Customer may request the application of the warranty against hidden defects, subject to a preliminary review of their claim. To verify the eligibility of the warranty claim, the Customer must provide reasons/justification for their request by sending an email to bonjour@maison-fevre.fr by attaching the following items to the email:

  • one or more photos of the defect found on the product;
  • A copy of the invoice is available in the “My Account” section.

The absence of any of the above elements will prevent the customer's request from being studied.

The warranty does not apply to the following repairs:

  • faulty use and/or improper use of the product which has altered its quality, shape, appearance (e.g. contact with cleaning products);
  • product deterioration that has altered its shine or color (e.g., spraying of a cosmetic product);
  • deterioration due to improper handling;
  • intervention carried out on the product by any other person not mandated by MAISON FEVRE Customer Service.

If the warranty does not apply and the Customer wishes to obtain a repair quote, they are invited to:

  • take one or more photographs of your defective Product and send them by email to: bonjour@maison-fevre.fr specifying your name, surname, order number entered in the “My account” section and providing details of your request;
  • Our MAISON FEVRE team will assess the feasibility of the repair;
  • You will receive a response or a quote by email as soon as possible;
  • If you approve the quote (including shipping and return costs), please print and sign it, adding the handwritten words “approved”, and then return it by email to bonjour@maison-fevre.fr ;
  • MAISON FEVRE invites the Customer to contact customer service at bonjour@maison-fevre.fr or by phone +0(4) 70 58 74 59 (Monday to Friday from 9 a.m. to 12 p.m. and from 2 p.m. to 4:30 p.m. - Excluding public holidays);
  • The Customer returns the following in a package: their signed quote, their return slip, their item, and their payment by bank check, duly completed, signed, and made payable to

Your item will be sent as soon as possible to the postal address specified by the Customer in the “My Account” section.

Article L217-16 of the French Consumer Code: When the buyer requests the seller, during the term of the commercial warranty granted upon the purchase or repair of movable property, to carry out repairs covered by the warranty, any period of immobilization of at least 7 days is added to the remaining term of the warranty. This period begins from the date of the buyer's request for service or the date the property is made available for repair, if the latter is later than the request for service.

INTELLECTUAL PROPERTY

Trademarks, domain names, products, images, videos, texts, and more generally, all information subject to intellectual property rights are and remain the exclusive property of the Official MAISON FEVRE store. No transfer of intellectual property rights is made through these Terms and Conditions. Any reproduction, in whole or in part, modification, or use of these assets for any reason whatsoever is strictly prohibited.

DISPUTE RESOLUTION

The Customer can submit any complaint by contacting the company using the following contact details: bonjour@maison-fevre.fr .

In accordance with the provisions of Articles L. 611-1 to L. 616-3 of the Consumer Code, the consumer is informed that he/she may resort to a consumer mediator under the conditions provided for in Title I of Book VI of the Consumer Code.

If the complaint to the Seller's customer service fails, or if there is no response within two months, the consumer may submit the dispute to a mediator who will attempt independently to bring the parties together in order to reach an amicable solution.

INTERNET NETWORK RESPONSIBILITY

MAISON FEVRE is only bound by an duty of reasonable care for all stages of access to the Site, from the ordering process to the shipment of the package. MAISON FEVRE shall not be held liable for any inconvenience or damage inherent in the use of the Internet, including service interruptions, external intrusions, the presence of computer viruses, or any event deemed to be force majeure, in accordance with applicable law and jurisprudence. The performance of MAISON FEVRE's obligations under this agreement shall be suspended in the event of a unforeseeable event or force majeure that prevents their performance. MAISON FEVRE will notify the Customer of the occurrence of such an event as soon as possible.

APPLICABLE LAW AND JURISDICTION

The terms and conditions are subject to French law.

In accordance with consumer law, in the absence of an amicable agreement, all disputes arising from these General Terms and Conditions, concerning their validity, interpretation, execution, termination, consequences and subsequent effects, shall be submitted to the competent court in accordance with the rules of jurisdiction under common law.

Any dispute must first be subject to an attempt at amicable settlement. In the absence of an amicable settlement, jurisdiction is conferred upon the competent French courts, notwithstanding multiple defendants or third-party claims.
